1. Sponsor: The sponsor of Nutakuvision: Idol Clash! (the “Giveaway”) is Nutaku Publishing Ltd (the “Sponsor”).

2. Eligibility: The Giveaway is only open to those who follow either Nutaku Publishing Ltd on Twitter (@NutakuPublisher) or on Instagram (nutaku_publishing_ivy) and have then replied to one of the Giveaway’s tweets or Instagram posts (those containing the #Nutakuvision2022 hashtag), respectively, and are twenty-one (21) years of age as of the date of entry. The Giveaway is open only to those located in countries and regions mentioned in Point 3, and these can change, without notice, at any point during or after the Giveaway and in the sole discretion of the Sponsor, and participation in the Giveaway is void where prohibited by law. Employees, independent contractors, interns, officers, directors, and agents of the Sponsor, their respective affiliates, subsidiaries, advertising and promotion agencies, suppliers and their immediate family members and/or those living in the same household of each are not eligible to participate in the Giveaway. The Giveaway is subject to all applicable federal, state, and local laws and regulations.

3. Eligible countries and regions, as stated by Amazon (the “Vendor”) AmazonGlobal Export Countries and Regions: Albania, Algeria, Andorra, Angola, Argentina, Armenia, Aruba, Australia, Austria, Bahrain, Bangladesh, Barbados, Belarus, Belgium, Belize, Bermuda, Bolivia, Bosnia And Herzegovina, Botswana, Brazil, Bulgaria, Cambodia, Cameroon, Canada, China, Croatia, Cyprus, Czech Republic, Denmark, Egypt, Fiji, Ghana, Hong Kong, Israel, Estonia, Jordan, Finland, Kenya, Cayman Islands, France, Chile, India, Germany, Kuwait, Indonesia, Colombia, Gibraltar, Greece, Costa Rica, Dominican Republic, Ecuador, Hungary, Kyrgyzstan, El Salvador, Iceland, Mauritius, French Guiana, Kazakhstan, Ireland, Italy, Latvia, Liechtenstein, Mayotte, Macao, Morocco, Malaysia, Namibia,  Lithuania, Nigeria, Luxembourg, Oman, Guadeloupe, Malta, Guatemala, Marshall Islands, Monaco, Pakistan, New Caledonia, Honduras, Netherlands, Norway, Jamaica, Martinique, Mexico, Poland, Palestinian Territories, Micronesia, Portugal, New Zealand, Qatar, Panama, Palau, Romania, Saint Barthélemy, San Marino, Reunion, Philippines, Saudi Arabia, Singapore, Senegal, Serbia, South Africa, Slovakia, Tanzania, Paraguay, Slovenia, Peru, South Korea, Spain, Tunisia, Sri Lanka, Saint Kitts and Nevis, Sweden, Switzerland, Saint Martin, Trinidad and Tobago, Uruguay, Turkey, Uganda, Venezuela, Ukraine, Taiwan, United Arab Emirates, Thailand, United Kingdom, Vatican City, Vietnam, Zimbabwe. This list is subject to change without notice by the Sponsor according to the Vendor’s shipping policies.

4. Agreement to Rules: By entering the Giveaway, the contestant (“you”, “your” and/or derivatives thereof) agrees to comply with and abide by these Rules and the decisions of the Sponsor, and you represent and warrant that you meet the eligibility requirements. You may refuse the Giveaway’s prizes when contacted by the Sponsor.  In addition, you agree to accept the Sponsor’s decisions as final and binding as it relates to the Giveaway. Giveaway entrants should direct any potential questions, comments, or issues related to the Giveaway solely to the Sponsor by contacting Sponsor on the respective social media account on which Entrant has or intends to enter the Giveaway on.

5. User data: the Sponsor shall not collect or use data submitted by a person entering the Giveaway (the “Entrant”), such as name, age, address or email address, except for the purpose of contacting the Entrant in case they are selected as a winner of the Giveaway, and agree that the rewards be shipped to them. The Sponsor shall not store or share Entrants’ data with any third party, unless necessary for ensuring a correct shipping and delivery of the Prizes (defined below).

6. Entry Period: The Giveaway begins on 04 July 2022 at 10:00AM EET and ends on 24 July 2022 at 11:59PM EET (the “Entry Period”). Entries submitted outside the Entry Period will not be eligible. The Winner(s) (defined below) will be announced at a date after the Entry Period, no later than 25 of July 2022.

7. How to enter: The Giveaway can be entered by following Nutaku Publishing on Twitter (@NutakuPublisher) or on Instagram (nutaku_publishing_ivy), and then replying to at least one (1) of the Giveaway’s tweets or Instagram posts, respectively. Each Entrant may participate in the Giveaway on both Twitter and Instagram, by following the Giveaway submission rules provided herein, but each Entrant may only win one (1) of the two (2) Prizes listed below. Entrants must fulfill all requirements of the Giveaway, as specified herein, to be eligible to win a Prize. Entries that are incomplete or do not adhere to the rules or specifications of the Giveaway may be disqualified, for any or no reason, and at the sole discretion of the Sponsor. You must provide any information requested. You may NOT enter multiple replies/comments on the same Twitter or Instagram post, or from multiple accounts, email addresses, identities, or devices in an attempt to circumvent the rules. If you are determined to have used fraudulent methods or otherwise attempted to circumvent the rules of the Giveaway, your submission may be disqualified at the sole discretion of the Sponsor, and at any time.

8. Prizes: Each of two (2), distinct winner(s) of the Giveaway (the “Winner(s)”) will receive the following prizes (the “Prize(s)”):

• One (1) winner on Twitter will receive a “YOWU RGB Cat Ear Headphone 4” set
• One (1) winner on Instagram will receive a “YOWU RGB Cat Ear Headphone 4” set

Each Winner shall only be eligible to win one (1) of the two (2) Prizes above.

9. Actual/appraised value of each of the Prizes may differ at time of Prize award. No cash, or other prize substitution shall be permitted or provided, except for at the Sponsor’s sole discretion. The Prizes are non-transferable. Substitution of the Prizes, or transfer/assignment of the Prizes to others, or request for the cash equivalent of the Prizes by the Winner(s) is not permitted. Any and all Prize-related expenses including, without limitation, any and all federal, state, and/or local taxes shall be the sole responsibility of the Winner. Acceptance of a Prize constitutes permission for the Sponsor, by the Winner(s) to use the Winner’s name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.

10. Prize order & payment: The Prizes will be purchased by the Sponsor from Amazon.com, or a similar vendor, on behalf of the Winners. The Sponsor will ensure the payment of the Prize and any shipping fees advertised by Vendor during the order process. The Sponsor is not responsible and shall not be held liable for paying any additional custom or local fees incurred in the country of the Winner. Once the order is placed and confirmed, shipping and delivery falls under the Vendor’s terms and policies. The Sponsor will confirm the order placement to the Winner and will provide him/her with all information provided by the Vendor regarding the order.

11. Prize Shipping: The shipping will be fulfilled by Amazon to the address indicated by the Winner to the Sponsor. Once the order is placed, the Sponsor is not responsible for ensuring any aspect of the order such as, but not limited to, delivery time, additional shipping fees, customs processes, contact of the local delivery service provider etc. The Sponsor is not responsible for incorrect or incomplete shipping addresses.

12. Winner selection: The Winners will be selected among those eligible by using a random Tweet reply and/or Instagram comment picker, under the supervision of the Sponsor.

13. Winner notification: The Winners will be notified within twenty-four (24) hours of the winner selection in a Direct Message on Twitter or Instagram, respectively. The Sponsor shall have no liability for a Winner’s failure to receive notices due to spam, junk e-mail or other privacy or security settings or for a Winner’s provision of incorrect or otherwise non-functioning contact information. The Winner is solely responsible for providing the Sponsor with a correct delivery address the Prize will be shipped to. If the Winner cannot be contacted, is ineligible, fails to respond to the Sponsor’s message within seventy-two (72) hours from the time the notification was sent, the Prize may be forfeited, and an alternate Winner selected. Any violation of the Rules by the Winner(s), and at the Sponsor’s sole discretion, may result in the Winner’s disqualification as winner, and all privileges as winner may be immediately terminated.

14. Rights granted by the potential Winners: By entering this Giveaway, you understand and agree that the Sponsor, and/or anyone acting on behalf of the Sponsor, or its respective licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the world, without limitation, your entry, name, portrait, picture, voice, likeness, image, statements about the Giveaway, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes without any further compensation, notice, review, or consent. 

15. Rules: The Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Giveaway at any time, or should a virus, bug, non-authorized human intervention, fraud, or other cause beyond the Sponsor’s control corrupt or affect the administration, security, fairness, or proper conduct of the Giveaway. In such cases, the Sponsor may select a winner(s) from eligible entries received before and/or after the action taken by the Sponsor, where and if appropriate. The Sponsor reserves the right, and at its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Giveaway or website or violates these Rules. The Sponsor has the right, in its sole discretion, to maintain the integrity of the Giveaway, to void entries for any reason, including, but not limited to: multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by Giveaway rules, the use of bots, macros, scripts, or other technical means for entering, or no reason whatsoever. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Giveaway may be a violation of criminal and civil laws. Should such an attempt be made, the Sponsor reserves the right to seek damages to the fullest extent permitted by law.

16. Limitation of liability: By entering the Giveaway you agree to release and hold harmless Sponsor and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) Entrant’s participation in the Giveaway and/or his/her acceptance, possession, use, or misuse of any Prize or any portion thereof; (ii) unauthorized human intervention in any part of the Giveaway; (iii) electronic or human error in the administration of the Giveaway or the processing of entries; (iv) technical errors of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (v) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (vi) printing errors; (vii) lost, late, postage due, misdirected, or undeliverable mail.

17. Disputes: This Giveaway is governed by the laws of the Republic of Cyprus, without respect to conflict of law doctrines. By participating in this Giveaway, you agree that any and all disputes that cannot be resolved between the parties to the same, and causes of action arising out of or connected with this Giveaway, shall be resolved individually, without resort to any form of class action, exclusively before a court located in the Republic of Cyprus. Further, in any such dispute, under no circumstances shall you be permitted to obtain awards for, and hereby waive all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than actual out-of-pocket expenses (i.e. costs associated with entering the Giveaway). You further waive all rights to have damages multiplied or increased.

18. The Giveaway is in no way sponsored, endorsed, administered by, or associated with Amazon, YOWU, Facebook, Twitter, Instagram, Snapchat, YouTube, Reddit, Pinterest, LinkedIn or any other social networks that may be used to share the Giveaway. You understand that you are providing your information to the owner of the Giveaway and not to YOWU, Facebook, Twitter, Instagram, Snapchat, YouTube, Reddit, Pinterest, LinkedIn, or any other social networks.

19. Acceptance of Rules: By participating in the Giveaway, you hereby confirm that you have reviewed, accepted, and agreed to the entirety of the Rules, as those may be from time to time, and that, should you become a Winner of this Giveaway, you hereby also consent to have your personal information processed for the purposes described herein.
